GUEST RENTAL TERMS AND CONDITIONS

Bluestone Main Estate  |  Main House  |  The Farmhouse (3 Kereru Lane)


The person making this booking ("Registered Guest" or "You") must be 25 years of age, or older and warrant that you are authorised to agree to these terms and conditions on behalf of all other occupants and take full responsibility to ensure that all occupants understand and agree to these terms and conditions.

By proceeding with this booking, you accept Bluestone Estate's ("Bluestone") terms and conditions outlined below.

RATES

Rates are displayed on the website and are in New Zealand dollars. They include the New Zealand Goods and Services Tax (GST). Rates are based on high season, low season and peak dates. Peak dates are outlined on the Bluestone Estate website and include but are not limited to the Christmas/New Year period and Easter.

Rates are subject to confirmation at the time of reservation and subject to all payments being paid by due dates.

The Registered Guest is responsible for any bank transfer/transaction fees. Credit card payments attract a 2.8% credit card fee.

PAYMENT

Your booking is confirmed upon the receipt of a 25% deposit of the value of the total stay. Additional services are quoted separately, but will also be included in the 25% confirmation deposit invoice.  

Final payment is required 90 days before your arrival date.  

Credit card details will be taken prior to or upon arrival and held as security for any costs incurred in relation to your obligations under these Terms and Conditions, and costs for any experiences booked during your stay.

Payment in full is required irrespective of whether you vacate the Property early.

Payment can be made by credit card, which attracts a 2.8% credit card fee payable by the Registered Guest, or by direct payment into Bluestone Estate's bank account. Guests are responsible for any bank transfer/transaction fees.

ADDITIONAL SERVICES

Where additional services are quoted and confirmed in writing at the time of booking, including but not limited to catering, in-house chefs, concierge arrangements, transport, guided experiences, equipment hire or any third-party services coordinated by Bluestone Estate, a deposit of 25% of the confirmed service value is required to confirm those services. The balance is due in accordance with the payment schedule set out under the Payment section of these Terms and Conditions.

In the event of cancellation of any confirmed additional service, any refund of monies paid is at the discretion of Bluestone Estate. Bluestone will endeavour to recover a full refund on the Registered Guest’s behalf, minus a $250 admin fee; however, any refund is subject to the specific terms and conditions of the relevant contractor, service provider or vendor and cannot be guaranteed. Bluestone Estate accepts no liability for amounts that are non-refundable under a third party’s cancellation policy.

Any additional services requested during your stay that have not been confirmed in advance will be charged in full upon completion and are payable prior to departure.

BOOKING AMENDMENTS AND CANCELLATIONS

MAIN ESTATE / MAIN HOUSE / FARMHOUSE

All requests for changes or cancellations to a booking must be made in writing by the Registered Guest to Bluestone Estate no later than 90 days prior to arrival. Every effort will be made by Bluestone Estate to accommodate date changes, and will depend on availability so it cannot be guaranteed. Bluestone will not accept date change requests due to transport delays or cancellations (e.g. airport, ferry, train or road delays or closures due to bad weather). Cancellations made after the above timeframe will result in the full payment for the total stay being forfeited.  Where Bluestone Estate is able to re-let the Property for the full cancelled period at the same or greater tariff, a refund of monies paid (less the booking administration fee) may be considered at Bluestone's sole discretion.

In the event of cancellations when the 25% deposit is eligible for refund (ie. for cancellations done with notice given more than 90 days prior to arrival), a booking fee of up to $500 shall be retained by Bluestone Estate to cover staff time and costs incurred.  

SECURITY DEPOSIT

An amount equivalent to $2,000 NZD ("Bond") will be pre-authorised on the guest's provided credit card at the start of your stay. This Bond (pre-authorisation) will be released within 5 business working days after payment is received for any services or experiences undertaken during your stay, and a post-stay inspection has been completed to confirm, at the reasonable discretion of Bluestone Estate, that there is no excessive cleaning required, excessive rubbish to be removed or any damage or loss to the Property. 

Please notify Bluestone Estate immediately should there be any damage to the property.

In the event that the Bond does not cover the cost of excessive cleaning, excessive rubbish or damage, or other costs incurred by you during your stay, you hereby authorise Bluestone Estate to debit the credit card provided for any costs following the post-stay inspection. In the event that there is a problem with the credit card being debited, you agree to immediately pay the amount owing in cash, bank cheque in NZ currency or by electronic funds transfer of cleared funds to Bluestone Estate.

You are responsible for all breakage, loss and/or damage to the Property, including direct and indirect costs, fines incurred, charges arising from actions of third parties, and damage caused to the Property (including any contents).

BOAT HOUSE / THE STUDIO

All requests for changes or cancellations to a booking must be made in writing by the Registered Guest to Bluestone Estate no later than 30 days prior to arrival. Every effort will be made by Bluestone Estate to accommodate date changes and will depend on availability so cannot be guaranteed. Bluestone will not accept date change requests due to transport delays or cancellations (e.g. airport, ferry, train or road delays or closures due to bad weather). Cancellations made after the above timeframes will result in the full payment for the total stay being forfeited.

In the event of cancellations within the required timeframes, a booking fee of up to $250 shall be retained by Bluestone Estate to cover staff time and costs incurred.

SECURITY DEPOSIT

An amount of NZ$300 ("Bond") will be pre-approved at the start of your stay on the credit card provided. This Bond will be released after payment is received for any services or experiences undertaken during your stay, and a post-stay inspection has been completed to confirm, at the reasonable discretion of Bluestone Estate, that there is no excessive cleaning required, excessive rubbish to be removed or any damage or loss to the Property.  The Bond will be released within 5 business days of a satisfactory post-stay inspection

Please notify Bluestone Estate immediately should there be any damage to the property.

In the event that the Bond does not cover the cost of excessive cleaning, excessive rubbish or damage, or other costs incurred by you during your stay, you hereby authorise Bluestone Estate to debit the credit card provided for any costs following the post-stay inspection. In the event that there is a problem with the credit card being debited, you agree to immediately pay the amount owing in cash, bank cheque in NZ currency or by electronic funds transfer of cleared funds to Bluestone Estate.

PROPERTY USAGE

The property is to be used for the purpose of short-term accommodation only and for the maximum number of occupants stated at the time of booking. The property may not be used for any commercial purposes, weddings, parties, gatherings or any other functions unless agreed prior with Bluestone Estate. Any additional guests, events or use of the property as a venue requires Bluestone's express permission in writing and may incur an additional fee. Please note that if authorisation for any of these occurrences is not obtained, guests will be required to leave the Property immediately and there will be no refund for the remainder of the stay, or of the security deposit (Bond).  Cookhouse event bookings are subject to separate Terms and Conditions.

The Compendium located at the Property contains House Rules and Policies. Please read and observe these rules and policies. In particular, there can be no loud noise or loud music at any time.

A representative of Bluestone Estate may enter the Property at any time to inspect the Property upon giving you (not less than) 2 hours' notice by phone or text.

GUEST ARRIVAL & DEPARTURE

Check-in is 3:00 pm and check-out is 11:00 am unless agreed by prior arrangement. Please lock all doors and close all windows. If there is any damage to the Property you must notify Bluestone Estate prior to your departure.

You are responsible for leaving the Property in the same clean, neat and tidy condition it was when you arrived. This includes: washing up, fridge cleaned out, BBQ cleaned, rubbish placed in appropriate bins when vacating the property. Should any excess cleaning or rubbish removal be required beyond what is considered reasonable, there will be an additional 2 hour minimum cleaning charge of $160 and at a rate of $80 plus GST per hour thereafter.

POST-STAY INSPECTION

Bluestone will conduct a post-stay inspection. If Bluestone, in its absolute discretion, is not satisfied with the condition of the Property, reasonable wear and tear excepted, Bluestone may deduct a reasonable sum from the Bond or debit the credit card provided, and will provide a written breakdown of the deduction.

INSURANCE AND NO LIABILITY

You will not do anything that could adversely affect Bluestone Estate's property owners insurance over the Property. In the event that Bluestone's insurance policy is used to cover damage caused by the Registered Guest or occupants, you will be liable for the excess on such policy.

Your personal effects are not insured by Bluestone. You acknowledge that all your personal items and vehicles (including vehicle contents) remain your responsibility and Bluestone accepts no responsibility for loss or damage.

Guests are strongly advised to protect themselves against cancellation charges, medical expenses or loss of personal possessions by way of comprehensive travel insurance taken out in the country of origin.

Please note that use by you or any of the occupants of Bluestone's extra facilities including, but not limited to, kayaks, dinghies, bicycles, trampolines, spas and swimming pools, is entirely at your own risk at all times. Bluestone's inground trampoline is only to be uncovered and used if specifically requested by the Registered Guest. Bluestone accepts no responsibility for any injury or loss on Bluestone Estate property or from using Bluestone equipment or facilities whatsoever. Children are to be supervised at all times by a parent or responsible adult.

HEALTH AND SAFETY

To the fullest extent possible at law, Bluestone Estate makes no representation and gives no express or implied warranty of any kind in relation to the Property, or any product or service featured on the website or brochure. Your use of the Property and services is at your sole risk.

ADDITIONAL

Bluestone is a non-smoking property. There is to be no smoking, vaping or illegal drug use on the property at any time.

No animals are permitted on the property except for working assistance dogs (Guide and Hearing Assistance dogs only).

While we respect guest privacy during your stay, we reserve the right for our manager to inspect the property at any time with a minimum of 2 hours' notice. This notice will be given verbally or by phone message.

Bluestone Estate holds the information you provide us in our secure system during your stay. We will retain your profile on our system after your departure. Your personal information is treated with utmost confidentiality and will never be distributed to parties outside Bluestone Estate. If you would like your personal information removed from our database, please advise us post-stay.  Bluestone Estate complies with the New Zealand Privacy Act 2020. You have the right to request access to and correction of personal information held about you.

COMPLAINTS AND DISPUTES

If any complaint or dispute arises under this Agreement, the parties will meet to discuss in good faith in an attempt to resolve it by negotiation. It is expected that any complaint or dispute will be resolved in good faith between the Registered Guest and Bluestone Estate owners within a reasonable period. In the unlikely event that this is not the case, the parties agree to the following process:

Neither party will commence or maintain any action or proceeding in any court, tribunal or otherwise regarding a dispute without first complying with the provisions of this clause 1 in this Complaints and Disputes section.

If a party considers that a dispute has arisen, it may issue a written Dispute Notice to the other party, setting out reasonable particulars of the matter in dispute. For a period of 20 working days after a party receives a Dispute Notice, the parties shall with best endeavours and in good faith negotiate to attempt to resolve the dispute and shall (subject to privilege) provide to the other party all information with respect to the dispute which is reasonably requested by the other party.

If the dispute has not been resolved within 20 working days after receipt of the Dispute Notice, or within such further period as the parties agree in writing, the parties shall attempt to settle the dispute by mediation before a mediator selected by the current President of the New Zealand Law Society.

If the dispute has not been resolved within 20 working days, or within such further period as the parties agree in writing, after the commencement of mediation, then either party may exercise any other legal rights which may be available to it.

Except where the dispute renders it impossible to do so, the parties will continue to be bound by their respective obligations under these Terms and Conditions while a dispute is being resolved.

Each party will use its best endeavours to ensure that, where a dispute is reasonably foreseeable, it is dealt with at a sufficiently early stage to ensure that there is a minimum effect on the ability of either party to perform its obligations under these Terms and Conditions.

Bluestone Estate does not accept any responsibility for any disturbances to you arising from work being carried out on neighbouring properties and land, and shall not be liable for any compensation or refund arising from any such disturbance or inconvenience, whether due to road works, construction, or any other nuisance or annoyance outside the control of Bluestone.

Bluestone will use best endeavours to ensure that the Property is presented as advertised; however, on occasion, as Bluestone is a rural property, there may be circumstances where certain services are unavailable (e.g. power outage) or the rural environment impacts guests (e.g. insects). In such circumstances, every effort will be made to ensure guest comfort; however, Bluestone will not be held liable for the loss or unavailability of any particular service, or any actions taken by any person or authority outside the control of Bluestone affecting the availability of such services.

These Terms and Conditions are governed and construed in accordance with the laws of New Zealand.
